1. Agreement to Terms

By accessing or using Dressi ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms apply to all users, including shoppers, brands, and visitors.

2. Description of Service

Dressi provides a virtual try-on service that allows users to:

• Upload photos and virtually try on clothing from various retailers
• Save and manage their virtual wardrobe ("Cher's Closet")
• Access try-on features via our website and Chrome extension
• Subscribe to premium features (for shoppers)
• Integrate virtual try-on into e-commerce sites (for brands)

3. User Accounts

3.1 Account Creation

To use certain features, you must create an account. You agree to:

• Provide accurate, current information
• Maintain the security of your password
• Be responsible for all activity under your account
• Notify us immediately of unauthorized use

3.2 Age Requirement

You must be at least 13 years old to use Dressi. Users under 18 should obtain parental consent.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms or illegal activity.

4. Subscription Plans

4.1 B2C Plans (Shoppers)

We offer the following subscription tiers:

• Free: 5 try-ons per month, 10 saved looks
• Basic ($4.99/month): 20 try-ons per month, 25 saved looks
• Plus ($9.99/month): 50 try-ons per month, 50 saved looks
• Premium ($19.99/month): Unlimited try-ons and saved looks

4.2 B2B Plans (Brands)

Brand subscriptions include a 14-day free trial (500 try-ons included, credit card required). After the trial, your card will be charged according to your selected plan.

4.3 Billing

• Subscriptions are billed monthly in advance
• Payments are processed securely via Stripe
• Usage limits reset on your monthly billing date
• Prices are subject to change with 30 days notice

4.4 Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. No refunds for partial months. See our Refund Policy for details.

5. Acceptable Use

5.1 Permitted Use

You may use Dressi for:

• Personal virtual try-on of clothing
• Saving and managing your virtual wardrobe
• Commercial use (brands integrating our service)

5.2 Prohibited Use

You may NOT:

• Upload photos of other people without their consent
• Upload inappropriate, offensive, or illegal content
• Use the Service to harass, abuse, or harm others
• Attempt to circumvent usage limits or security measures
• Reverse engineer, decompile, or hack the Service
• Use automated tools (bots, scrapers) without permission
• Resell or redistribute the Service
• Upload photos of minors without parental consent

6. User Content

6.1 Your Content

You retain all rights to photos and content you upload ("Your Content"). By uploading, you grant Dressi a limited license to:

• Process your photos to provide virtual try-on service
• Store your content for the duration of your account
• Display your content to you within the Service

We will NEVER use your photos for marketing or share them with third parties without your explicit consent.

6.2 Content Responsibility

You are solely responsible for Your Content and warrant that:

• You own or have rights to upload the content
• The content does not violate any laws or third-party rights
• The content is not defamatory, obscene, or offensive

6.3 Content Removal

We reserve the right to remove any content that violates these Terms or is reported as inappropriate.

7. Intellectual Property

7.1 Our IP

Dressi owns all rights to the Service, including:

• Website design, code, and functionality
• Chrome extension
• Trademarks, logos, and brand assets
• Virtual try-on technology and algorithms

You may not copy, modify, distribute, or create derivative works without our written permission.

7.2 Third-Party IP

Product images and brand names belong to their respective owners. Dressi does not claim ownership of third-party content displayed through the Service.

8. Privacy and Data

Your use of Dressi is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.

9. Disclaimers and Limitations

9.1 "As Is" Service

Dressi is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including:

• Accuracy of virtual try-on results
• Uninterrupted or error-free operation
• Fitness for a particular purpose

9.2 Try-On Accuracy

Virtual try-on results are approximations and may not perfectly represent how clothing will look in real life. Factors like fabric texture, fit, and lighting may differ. We do not guarantee accuracy.

9.3 Third-Party Sites

Dressi provides links to third-party shopping websites. We are not responsible for their content, policies, or practices. Purchases made on those sites are subject to their terms.

9.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRESSI SHALL NOT BE LIABLE FOR:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages resulting from unauthorized access to your account
• Dissatisfaction with products purchased from third-party sites

Our total liability shall not exceed the amount you paid to Dressi in the past 12 months.

10. Indemnification

You agree to indemnify and hold harmless Dressi, its officers, directors, employees, and agents from any claims, damages, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload

11. Dispute Resolution

11.1 Governing Law

These Terms shall be governed by the laws of [Your State/Country], without regard to conflict of law principles.

11.2 Arbitration

Any disputes arising from these Terms shall be resolved through binding arbitration, except for:

• Small claims court actions
• Intellectual property disputes

13. Termination

You may terminate your account at any time from Settings. Cancellation takes effect immediately, but you may retain access until the end of your billing period.

13.2 By Us

We may terminate or suspend your account immediately if you:

• Violate these Terms
• Engage in fraudulent activity
• Fail to pay subscription fees
• Use the Service in a way that harms us or others

13.3 Effect of Termination

Upon termination:

• Your right to use the Service ends immediately
• Your data will be deleted (see Privacy Policy)
• Unpaid fees remain due
• Sections 6-11 of these Terms survive termination

14. Miscellaneous

14.1 Entire Agreement

These Terms, along with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Dressi.

14.2 Severability

If any provision of these Terms is found invalid, the remaining provisions remain in effect.

14.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

14.4 Assignment

You may not assign these Terms. We may assign them to an affiliate or in connection with a merger or acquisition.
